Article 1 – Definitions
In these terms and conditions, Place de la Famille (PdlF) is the one who offers holiday accommodation for payment, and you as the tenant are the other party or the person on whose behalf the rental agreement has been concluded. The amounts stated include VAT (PdlF is liable for tax in France, TVA). Dutch law applies to the rental agreement.
Article 2 – Booking
After your (online) booking request, you will receive an offer from us along with a booking confirmation and invoice. The rental agreement is concluded as soon as we have received your deposit. Our offer is without obligation and we may withdraw it up to 48 hours after your acceptance in order to correct errors in the calculation; any amounts already paid will then be refunded to you immediately. Obvious errors and mistakes are not binding on us.
Article 3 – Arrival and departure
On the day of arrival, your accommodation is available from 16:00; on the day of departure, you leave the accommodation before 09:00, unless we agree otherwise together.
Article 4 – Payment
Your booking is final after payment of the deposit of 30% of the total trip price, no later than 7 days after the invoice date. You pay the remaining amount no later than 90 days before arrival. If you book within 90 days of arrival, you pay the entire trip price immediately. If you do not pay on time after a reminder, we may terminate the agreement; the cancellation conditions of Article 7 will then apply.
Article 5 – The trip price
The published rental price applies per accommodation. The trip price consists of the rental price plus the compulsory cleaning and booking costs and the extras chosen, such as towel packages and meals. The published prices are based on the prices, levies and taxes known at the time of publication.
Article 6 – Changing and substitution
Up to 90 days before arrival, you can request a change to your booking (accommodation, dates); we will carry this out where possible. From 90 days before arrival, a different accommodation is no longer possible; extras and meals can still be added up to 2 days before arrival. If you are unable to come yourself, someone else may take your place by arrangement, provided you request this no later than 7 days before arrival; you will both remain jointly liable for any amount still owed.
Article 7 – Cancellation
If you cancel your booking, the following costs apply: up to 13 weeks before arrival 70% refunded. If you cancel within 90 days before arrival, the full trip price is due, including the booked extras.
Article 8 – Termination by us
In the event of serious or exceptional circumstances, such as fire or natural disasters, we may terminate the agreement. Where possible, we will then offer an equivalent alternative; if this is not possible or you decline it, we will refund the full trip price. We do not compensate for any other damage.
Article 9 – Liability
If your stay does not proceed as you could reasonably expect on the basis of the agreement, please report this to us as soon as possible and in any case within 24 hours, so that we can look for a suitable solution. If we are liable for loss of enjoyment of the holiday, the compensation is at most once the rental price. We are not liable for damage or injury, nor for loss, theft or damage to property, and not for force majeure.
Article 10 – Stay rules
You are liable for damage to or loss of our property and you follow our instructions. The accommodation may not be occupied by more people than the maximum stated in the description. Smoking is not permitted on the grounds, in the accommodations, the bathing facility or the other communal areas. Pets are not allowed, with the exception of Gîte La Mauratie, by arrangement. You keep the swimming pool access gate closed throughout your entire stay, for yourself, your children and your guests. Anyone who causes so much nuisance that a pleasant stay for others is made difficult may be excluded from further participation by us; the costs of this are at their own expense.
Article 11 – Late payment
If you do not pay on time, you will owe interest on the trip price of 1% per month or part of a month, plus extrajudicial collection costs of 15% of the amount owed with a minimum of € 50.
